Bank of America, Illinois Magistrate Judge Daniel G. Martin recommended that the defendant’s Motion for Sanctions should be granted in part and denied in part, recommending that the plaintiffs be barred from using any new information at summary judgment or at trial that was contained on eight CD-ROMs produced late, but recommending no sanctions for failing to produce or make REDACTIONS AREN'T ALWAYS AS STRAIGHTFORWARD AS YOU THINK On the surface, it may seem easy enough to redact a document during eDiscovery review to obscure confidential or privileged information. You may think that all you need to do is draw a black box over the affected text, but there’s actually a lot more to consider in order to ensure that you don’t inadvertently produce information that was intended to be redacted. Here are a some redaction DON’T BE “DUPED”, FILES WITH DIFFERENT HASH VALUES CAN A couple of months ago, we published a post discussing how the number of pages in each gigabyte can vary widely and, to help illustrate the concept, we took one of our blog posts and put it into several different file formats to illustrate how each file had the same content, yet was a different size. That’s not the only concept that example illustrates. EDISCOVERY CASE LAW: ADVERSE INTERFERENCE SANCTION FOR As the sources of electronic files continue to become more diverse, case law associated with those different sources has become more commonplace. One ruling in a case last month resulted in an adverse instruction against the US Government for failing to preserve textmessages.
COURT INFERS BAD FAITH FOR PLAINTIFFS USE OF EPHEMERAL In Herzig v. Arkansas Foundation for Medical Care, Inc., Arkansas District Judge P.K. Holmes, III indicated his belief that the use and “necessity of manually configuring Signal to delete text communications” on the part of the plaintiffs was “intentional and done in bad faith”. EDISCOVERY BEST PRACTICES: DATABASE DISCOVERY POP QUIZ Databases: You can’t live with them, you can’t live without them. Or so it seems in eDiscovery. On a regular basis, I’ve seen various articles and discussions related to discovery of databases and other structured data and I remain very surprised how few legal teams understand database discovery and know how to handle it. WHAT CLIENTS ARE SAYING ABOUT CLOUDNINE DISCOVERY PRODUCTION This software is easy to use and allows us to upload and download documents as they become ready, saving us both time and money. Stephanie Plake, Assistant to Attorney at Law Office GREAT E-DISCOVERY COMPANY! We have worked with CloudNine on several cases, and have been quite happy with the service that we have received. Their support staff is responsive, friendly and helpful in assisting me with providing the technical information that my clients need. Their review platform, CloudNine, is robust, easy to use and ideal for a firm like ours where we don’t have to buy and support the software. Katherine Gonyea, Senior Associate at Dow Golub Remels & Beverly, LLP GREAT DATABASE FOR BOTH SMALL AND VOLUMINOUS LITIGATION MATTERS. User friendly software and great customer service! Margaret Masters, Paralegal at The Benson Firm LLPLONG-TIME USER
I have used the software, and their other services, for many years, through several versions, since. I have also used many other tools over the years, and each have their pros and cons. When I need something that can easily be shared with outside counsel, reviewed by multiple people simultaneously, and provide a fast reliable output, with fairly robust searching, this is my go-to product. The key for me is that the web-based platform makes collaboration across different companies/firms simple and efficient without the requirement for large downloads or additional purchases. The platform is intuitive and I would recommend it for any projects where collaboration is necessary. Brian Carter, Senior Counsel at Tetra Pak Inc. REVIEWED, ANALYZED AND TAGGED 100,000+ DOCUMENTS AS PART OF CLASSACTION LAW SUIT.
Overall great experience. Software is very user-friendly. Search filters were very helpful. Customer service was always quick to diagnose and solve any issues I ran into or answer any questions I had. I would definitely use this product and CloudNine in the future.
