Yes, COBRA premiums can be paid out of your HSA and you can continue coverage. In addition, if you are unemployed and are receiving unemployment compensation, you can purchase other healthcare insurance with your HSA. You cannot pay for COBRA premiums with a Flexible Spending Account (FSA). FURLOUGH VS LAYOFF AND COBRA ELIGIBILITY Furlough vs Layoff. A furlough is temporary, with a specific end date, although the furlough can be extended beyond the initial period or converted later into a layoff. In a furlough, the employee experiences a forced, unpaid leave of absence, but is still an employee. A layoff does not include a planned date for returning to work. HOW A MID-YEAR CHANGE OF STATUS AFFECTS HSA CONTRIBUTIONS Option A would result in an annual limit of $5,150, but option B would result in an annual limit of $6,850. Under the “greater of” provision of the Full-Contribution Rule, John may contribute the full $6,850 for that year.
