W związku z tym, że NIK podlega Sejmowi, Banaś "był zmuszony poinformować marszałek o naruszeniu prawa przez organy procesowe prowadzące postępowanie przygotowawcze". Rzecznik Prokuratury Regionalnej w Białymstoku, która prowadzi śledztwo w sprawie nieprawidłowości w oświadczeniu majątkowym szefa NIK, Paweł Sawoń powiedział, że są prowadzone czynności w sprawie tegośledztwa

ZAPISY PRAWA KARNEGO Sprzeczne informacje ws. syna Mariana Banasia i działań CBA Krzysztof Paszyk przypomniał, ze jego partia przed powołaniem nowego szefa NIK apelowała o zwrócenie uwagi na to, że pewne sprawy związane z Marianem Banasiem nie zostały załatwione. Stwierdził również, że istnieje możliwość jego odwołania. - Wskazywaliśmy chociażby na sprawdzanie przez CBA jego stanu majątkowego. Jeśli chodzi o sposób na pozbawienie stanowiska Mariana Banasia, to wystarczy zwrócić uwagę na zapisy w prawie karnym. Osoba składająca nieprawdziwe oświadczenia majątkowe podlega odpowiedzialności. W związku z tym prokuratura powinna przeprowadzić odpowiednie czynności. Pan Banaś, rozliczony i skazany prawomocnie przez sąd, mógłby przestać być szefem NIK -wskazał polityk.
