Third degree rape is a rape committed when the anal, oral, or vaginal sexual intercourse is deemed to be without the lawful consent of a victim because it is committed under any one or more of the following circumstances: (1) When the victim is incapable of resisting or of understanding the nature of the act by reason of a stupor or abnormal condition of mind produced by an intoxicating CUSTODY: CAN A SEX OFFENDER GET CUSTODY OR VISITATION The judge cannot award custody or unsupervised visitation to a sex offender unless the judge specifically determines that the sex offender poses no danger to the child. The judge is supposed to assume (although the other parent can try to convince the judge otherwise) that it is not in the best interest of the child to be in the care or custody of a sex offender, to have unsupervised AT THE HEARING: HOW DO I QUESTION A WITNESS? You can start questioning your witnesses, one at a time, by asking them their name and asking them some background information, like how they know the parties in the case. You will then have to get into asking questions about the event they witnessed or any other issue they are there to testify about. When people are injured by others, they are permitted to seek what the law refers to as “damages,” in the form of money, for such things as medical bills, lost wages or employment, physical and emotional pain and suffering, and, in some cases, topunish the abuser.
INA § 240A (8 USC § 1229B)- CANCELLATION OF REMOVAL (a) Cancellation of removal for certain permanent residents The Attorney General may cancel removal in the case of an alien who is inadmissible or deportable from the United States if the alien-- (1) has been an alien lawfully admitted for permanent residence for not less than 5 years, (2) has resided in the United States continuously for 7 years after having been admitted in any status, and IF V WAS DEPORTED, CAN SHE STILL APPLY FOR VAWA OR U VISA?
